MARCH 2022 MEETING MINUTES

The Pony Creek Homeowners Association Board met at the home of Tim Gibbs on March 8th, 2022. The meeting was called to order at 6:30pm. Board Members present included:  Verlin Phelps, President, Tim Gibbs, Vice President, Suzanne Wick, Treasurer, Board Members: Randy Greenwood and Mike Bogenreif.   

 Suzanne Wick emailed copies of the February 2022 Monthly Treasurer report and the February 2022 Meeting Minutes prior to the meeting. Hard copies were also available at the meeting. A motion was made by Randy to accept the minutes as submitted. Mike Seconded. All approved.

Treasurer Report:   Motion made by Tim to accept the Treasurer Report as submitted. Seconded by Mike.  All approved.  

Monthly Report Bank Statement balance March 1st, 2022, $ 5,808.83.

Balance in the Checking account  =  $ 3,205.07 as of March 5th, 2022.  Expenses paid during March included, Water Testing,  Payment to Smith Petersen Law Firm, Fred’s Trash, Lockewell Company,  AWWA (water class). Tractor payment and Mid-American Energy.  

Update on Court Cases – PCHA vs SMITH  Permanent Injunction was granted to PCHA against SMITH

                                                PCHA vs PERIAN – Appeal to original case was held February 28th, 2022 – under advisement by the Judge at the time of this meeting.  Received notice from Court on March 17th that ordered PERIAN to pay the 2014 Assessment, the 2020 increase in dues, current dues and late fees.

Water Report:  DNR issued a new Permit that along with the standard water testing procedures we currently conduct,  a monthly test for Arsenic shall be added to the Permit. A notice regarding the Arsenic level in our water was sent to all Homeowners. The notice was included in the packets that were sent out on March 1st, 2022. The packets included the DNR letter, the  Election materials and an Annual Meeting flyer.   The Arsenic level was just barely over the limit set by the DNR.

Well 3 – Pump and motor needed to be replaced. The Well tends to run dry and burns out the pump. We had Driver Plumbing install new pump and motor along with a sensor to shut the pump off when the Well runs dry. The last time the pump was replaced was 6 years ago. These pumps should last around 20  years. We hope that with the installation of the sensor that this new pump will last longer than previous pumps.

Road Report:  We are holding off on bringing in any rock at this time as snow is in the immediate forecast.  

Park:  A letter needs to be sent to Homeowner regarding driving on Park property.  The continued use could cause permanent damage.

Old Business:

·         Lot 1 would like the Board to get his fence repaired, which was damaged during snow removal operations.     

·         Website is under construction.      

·         Bids for mowing and weed eating at the park, Bus Shed and Community Building.  

·         Packets sent out to all Homeowners regarding updates to the By Laws and the upcoming elections that will be held in May.       

New Business:  General Meeting to be held May 15th, 2022 at 2 pm at the Park (Potluck).

Tim requested permission to barricade the drive that had been constructed across from Lot 2 to stop anyone from using it.

Tim made a motion to adjourn the meeting at 7:07 p.m. Mike seconded. All Approved.

Next Board meeting to be held April 12th , 2022, at 6:30 at Tim Gibbs House
